Lifetime Guarantee

This manufacturer’s guarantee applies to all suitcases purchased after Jan 25th, 2021. For orders placed on or before Jan 25th, 2021, send a mail to info@alupacific.com

Products covered by this Guarantee

This limited Manufacturer’s guarantee extends to all suitcases manufactured by AluPacific and purchased directly from AluPacific. The suitcase is designed to be used for travel by air, boat, car, train, and foot. This Guarantee does not cover your suitcase if you use it in a manner incompatible with that intended design.

Who this Guarantee extends to

This limited Guarantee extends to the original purchaser of any suitcase or, in the case of a gift, the original recipient of the suitcase. The “original purchaser,” for the purposes of this Guarantee, is the first purchaser of the suitcase from AluPacific. The “original recipient” for purposes of this Guarantee, is the first receiver of the suitcase purchased as a gift from AluPacific. All AluPacific Guarantee’s, including any implied warranties, are valid only for the period of time the suitcase is owned by the original purchaser/ recipient of the suitcase. A COPY OF THE PURCHASE RECEIPT IS REQUIRED TO DETERMINE GUARANTEE APPLICABILITY.

AluPacific limited Guarantees are not transferable and not applicable to use of the suitcase for commercial or rental purposes.

AluPacific Limited Guarantees and Responsibilities

AluPacific Guarantees the suitcase in its original packaging sold to you against the defects in material and workmanship set forth below (“Defects”) forever, when the suitcase is used normally for its intended purposes.

 

What this Limited Lifetime Guarantee Covers

This Limited Guarantee Applies to the Following Defects:

• Cracks or breaks in the shell

• Wheels, handles, or telescoping handles that break off and are no longer usable

This Limited Guarantee does not cover the Following:

• “Cosmetic Damage” which is defined as scratches, dents, dings, scuffs, stains, color changes, normal wear and tear, technological obsolescence, or other non-functional changes in the appearance of the product that occur during normal handling and use of suitcase.

• Replacement of any non-defective pieces in the suitcase (for example, if you purchase the suitcase with multiple components and only one component is defective, then we will only replace the defective component).

• Loss of functionality due to consumers being locked out of their suitcase. See “Your Responsibilities” below for information regarding assistance with locked suitcase.

If the defect is covered by the Guarantee, AluPacific will repair or replace the product. You will be responsible for the cost of shipping your suitcase to AluPacific. AluPacific will then cover the costs incurred, including the return shipment. The product may be replaced or repaired with parts of a comparable successor that is as close as possible to the former product/component, if an identical replacement is not available. The guarantee is limited to the value of the product. A replacement product is also covered by the lifetime guarantee. Any other claims not expressly mentioned in these terms, including but not limited to damage claims (e.g., indirect, incidental, consequential, special, punitive, exemplary, or other similar types of damages), are excluded. 

Your Responsibilities

In the event of a Defect and in order to get the benefit of this limited warranty, you must return your suitcase to AluPacific and provide AluPacific with proof of the original date of purchase. You will be responsible for the shipping costs to AluPacific. Evidence of a Defect and any claims must be sent to support@alupacific.com

AluPacific will repair or replace (as applicable) and ship your suitcase back to you within 60 days of receiving your original suitcase. You will not be responsible for any shipping costs associated with shipping replaced or repaired suitcase for European shipping addresses. Shipping charges for international addresses will be quoted after your submission of warranty request. Replaced or repaired suitcase is subject to the same limited warranty as the original suitcase.

Suitcases that are locked can be shipped to AluPacific to be unlocked by AluPacific personnel. You will be responsible for any shipping and handling costs.

Disclaimer and Limitation on Liability

TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, THE SUITCASE IS PROVIDED “AS IS” AND THIS WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. 

JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS LIMITED GUARANTEE, IN NO EVENT WILL AWAY OR ITS SUPPLIERS BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE SUITCASE OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF AWAY HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. ALUPACIFIC’S TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE SUITCASE GIVING RISE TO SUCH LIABILITY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

Governing Law

This guarantee will be governed by the Law of the Netherlands. Your country-specific warranty rights remain unaffected and may differ in the way they regulate liability for defects, compensation claims etc.
